Industry Update: Flight Duty Time Exemptions Move to Regional Model

Transport Canada (TC) has confirmed that the proposed global Flight Duty Time exemption will not proceed. Instead, a regional exemption approach will be implemented, while maintaining the same framework originally developed under the Regulatory Sandbox.


What This Means

Although the method for granting exemptions has changed, the conditions remain unchanged. Applicants must still follow the original Regulatory Sandbox model and have an approved “Streamlined” Fatigue Risk Management System (FRMS). Operators can apply under CARs 700.28, 700.29, or both, depending on their operational needs. It is important to note that once approved and implemented, you cannot switch back and forth between the exemption and the existing CARs.


A major goal of the program is to collect reliable data to support future rulemaking. It is mandatory for operators to collect this data and submit regular reports to allow TC to adapt quickly if new mitigations are needed.

 

How the Process Works

  • Applications will be submitted through regional Principal Operations Inspectors (POIs)

  • Final approvals will be handled by headquarters to ensure consistent, standardized outcomes across operators

  • Guidance is being distributed to regions to prepare for a high volume of early applications

 

Timelines and Next Steps

  • Processing timelines remain up to 90 working days, though early applications may move faster as templates are established

  • Several requests are already underway, helping to streamline future approvals

  • Operators are encouraged to engage their POIs now and begin preparing their Fatigue Risk Management System plans using available templates

 

Bottom Line

While the global exemption is no longer moving forward, the regional approach delivers the same opportunity, offering operators the flexibility they have long needed while maintaining high safety standards.
